1. Acceptance of Terms
By accessing or using the KYMA ICOSA platform ("Platform"), operated by KYMA Tech Solutions / Sage Holdings LLC ("Company," "we," "us"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree, do not use the Platform. Your continued use constitutes acceptance of any updated Terms posted here.
2. Description of Services
KYMA ICOSA provides AI compliance assessment services using a multi-model Byzantine Fault Tolerant consensus protocol. Services include the AI CR Sentinel (advisory scan), Pre-Statement Baseline (pattern detection), Full Council Certification (BFT consensus with blockchain attestation), and related remediation and consulting services. Service tiers, pricing, and deliverables are described on each respective product page.
3. Eligibility
You must be at least 18 years old and have the legal capacity to enter into binding agreements to use our services. If you are using the Platform on behalf of an organization, you represent and warrant that you have authority to bind that organization to these Terms.
4. User Accounts
Certain features may require account registration. You agree to provide accurate, current, and complete information, and to update it as necessary. You are responsible for maintaining the confidentiality of your credentials and for all activity under your account. Notify us immediately at compliance@kymatech.io of any unauthorized use.
5. Payment Terms
Fees for services are as listed at the time of purchase. All payments are due at the time of order submission. We accept credit/debit cards, cryptocurrency, and CashApp. All fees are non-refundable except as expressly stated herein or required by applicable law. Prices are in USD unless otherwise specified.
6. Intellectual Property
The ICOSA protocol, multi-model consensus methodology, and all related technology are the intellectual property of KYMA Tech Solutions / Sage Holdings LLC (Patent Pending: App. No. 63/789,142). All content, trademarks, logos, and software on the Platform are owned by or licensed to us. You may not reproduce, distribute, modify, or create derivative works without our prior written consent.
7. Scope of Assessment
ICOSA assessments evaluate AI systems against specified regulatory frameworks based on information you provide. Assessments are performed by AI models and do not constitute legal advice, formal legal opinions, or official regulatory determinations. The quality and accuracy of assessments depend on the completeness and accuracy of the information you supply through the Observation Framework.
8. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, KYMA TECH SOLUTIONS / SAGE HOLDINGS LLC SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF THE PLATFORM OR RELIANCE ON ASSESSMENT RESULTS. OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT PAID BY YOU FOR THE SPECIFIC SERVICE GIVING RISE TO THE CLAIM.
9. Disclaimer of Warranties
THE PLATFORM AND ALL SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT ASSESSMENTS WILL BE ERROR-FREE, THAT COMPLIANCE WITH ASSESSMENT RECOMMENDATIONS WILL GUARANTEE REGULATORY COMPLIANCE, OR THAT THE PLATFORM WILL BE UNINTERRUPTED.
10. Data Handling
Information submitted for assessment is processed in accordance with our Privacy Policy. System descriptions and assessment data may be transmitted to third-party AI model providers for the purpose of conducting multi-model consensus evaluation. We implement reasonable technical and organizational measures to protect your data but cannot guarantee absolute security.
11. Blockchain Records
Certification-tier verdicts are anchored to the Polygon blockchain. By proceeding with a Full Council Certification, you acknowledge and consent to the creation of an immutable, publicly verifiable blockchain record associated with your assessment. Blockchain records cannot be modified or deleted after creation due to the inherent nature of distributed ledger technology.
12. Prohibited Uses
You agree not to:
- Use the Platform for any unlawful purpose or in violation of any applicable law
- Submit false, misleading, or intentionally incomplete information for assessment
- Attempt to reverse-engineer, decompile, or extract source code from the Platform
- Interfere with or disrupt the Platform's infrastructure or security measures
- Misrepresent ICOSA assessment results or forge compliance certificates
- Use the Platform to gain competitive intelligence about the ICOSA protocol
13. Termination
We may suspend or terminate your access to the Platform at any time, with or without cause, with or without notice. Upon termination, your right to use the Platform ceases immediately. Sections that by their nature should survive termination (including limitation of liability, intellectual property, and dispute resolution) shall survive.
14. Governing Law & Dispute Resolution
These Terms are governed by the laws of the State of Delaware, without regard to conflict of law principles. Any dispute arising from these Terms or your use of the Platform shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association, conducted in Delaware. You waive any right to participate in a class action.
15. Changes to Terms
We reserve the right to modify these Terms at any time. Changes become effective upon posting to the Platform. Your continued use after changes are posted constitutes acceptance of the revised Terms. We encourage you to review these Terms periodically. Material changes will be communicated via email to registered users when practicable.
